Terms of Use
These terms govern use of the fAIr Advantage Ohio website, contact form, education materials, and grant application process.
Effective date: July 7, 2026
Agreement. fAIr Advantage Ohio is operated by New Era Systems LLC, Columbus, Ohio. By using the website or submitting a form, you agree to these Terms of Use. If you submit information for a business or organization, you represent that you are authorized to do so.
The Program
fAIr Advantage Ohio is an AI education and grant-support program operated and administered by New Era Systems LLC. It is not a government benefits program and is not a promise that any applicant will receive funding, reimbursement, services, tools, or business results.
New Era Systems may review, approve, decline, waitlist, or withdraw applications according to the program’s published framework, available funds, eligibility rules, application quality, conflicts, and administrative requirements. Awards are subject to available funding, final review, required documentation, and any award agreement or receipt requirements.
Eligibility and Age
Applicants must be at least 18 years old and authorized to apply on behalf of the business. If a minor-owned or youth-led business wants to apply, a parent, guardian, or other authorized adult must submit the application and accept responsibility for the submission.
Applications and Submissions
You are responsible for making sure information you submit is accurate, current, lawful, and complete. Do not submit confidential third-party information, private personal information, trade secrets, copyrighted materials, presentations, images, or files unless you have the right to provide them to New Era Systems for program review and administration.
You keep ownership of materials you submit. You grant New Era Systems a limited right to store, copy, review, evaluate, summarize, and use those materials as needed to administer the program, communicate with you, maintain records, prevent fraud or abuse, comply with law, and manage awards or reimbursements. We will not publish your application, attachments, name, or story without permission, unless required by law.
Grant Awards
Grant awards are not loans, equity investments, or guarantees of future support. Subscription awards may be paid directly to vendors. Other approved costs may require reimbursement after eligible spending and receipt review. Taxes, accounting treatment, and reporting obligations are the applicant’s responsibility; consult a qualified tax professional about your situation.
Education Materials
Sessions, recordings, articles, examples, and other educational materials are provided for general information. They are not legal, tax, accounting, financial, cybersecurity, or professional advice. You are responsible for deciding whether any AI tool, vendor, workflow, or recommendation is appropriate for your business.
Acceptable Use
- Do not submit false, misleading, unlawful, infringing, harmful, or malicious content.
- Do not use bots, scraping, spam, credential attacks, malware, or automated submissions against the site or forms.
- Do not attempt to access the CMS, applications, attachments, servers, accounts, or systems without authorization.
- Do not interfere with the site’s operation or attempt to test, bypass, or defeat security controls without written permission.
Communications
By submitting a contact form or grant application, you authorize New Era Systems to contact you at the email address or phone number you provide about your question, application, sessions, award status, documentation, receipts, reimbursements, or related program administration. You are responsible for providing current contact information.
Intellectual Property
The website, program name, branding, text, graphics, layouts, session materials, and other site content are owned by New Era Systems LLC or its licensors unless otherwise stated. You may view and use site materials for your own internal business or educational purposes. You may not copy, sell, imply endorsement, remove notices, or reuse branding or site content in a misleading way without permission.
Third-Party Services
The site may refer to third-party websites, AI tools, vendors, products, services, or resources. Those third parties are responsible for their own services, terms, privacy practices, pricing, security, and performance. Links or references do not mean New Era Systems controls or endorses a third party.
Privacy
Use of the site and forms is also governed by the Privacy Policy, which explains what information is collected, how it is used, how attachments are handled, and how to contact us about privacy requests.
Disclaimers
The site, program, forms, CMS, materials, and communications are provided “as is” and “as available.” To the fullest extent permitted by law, New Era Systems disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and uninterrupted operation. Nothing on the site guarantees funding, eligibility, selection, vendor performance, AI output quality, cost savings, revenue, compliance, or any business outcome.
Limitation of Liability
To the fullest extent permitted by Ohio law, New Era Systems LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, loss of goodwill, or costs of substitute services arising from use of the site, program, forms, materials, third-party services, or grant process. To the fullest extent permitted by law, New Era Systems’ total liability for any claim is limited to $100.
Indemnity
You agree to defend and hold harmless New Era Systems LLC from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these terms, your submitted materials, your misuse of the site or program, your infringement of another person’s rights, or false or unauthorized information you provide.
Changes and Access
New Era Systems may update the site, program, forms, selection process, awards, funding availability, these terms, or related policies as the program changes. We may suspend access, reject submissions, remove content, or decline to communicate further when needed to protect the site, program, applicants, administrators, or legal obligations. The effective date above shows when this version was last updated.
Governing Law and Venue
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any lawsuit or court proceeding related to the site, program, forms, applications, or these terms must be brought in the state or federal courts located in Franklin County, Ohio, unless applicable law requires a different forum.
